These Terms of Service ("Terms") are an agreement between you and SearchAcre ("SearchAcre," "we," "us," or "our"), governing your access to and use of searchacre.com (the "Site"). By using the Site or submitting information through it, you agree to these Terms. If you do not agree, do not use the Site.

1.The Site is informational

The Site describes what we do. Nothing on it is an offer to contract, and submitting a form does not create a client relationship, reserve anything for you, or obligate us to provide services.

Services are provided only under a separately executed statement of work or service agreement ("Service Agreement"). Where these Terms and a signed Service Agreement conflict, the Service Agreement controls for the services it covers.

2.Market availability checks

We limit how many clients we serve in a given city and service category. Submitting a market availability check lets us tell you whether we currently have capacity there. It does not reserve, hold, or guarantee availability, and availability can change between your inquiry and any agreement.

Any limit on how many clients we serve in a market applies only for the term of a signed Service Agreement and only within the scope defined in it. It is not a guarantee that no other business will compete with you, advertise against you, or appear alongside you in search results.

3.No guarantee of results

SearchAcre provides content production, publishing, and search visibility management services. This section is important, so please read it carefully.

Search results on third-party platforms are determined by those platforms and are affected by factors outside our control, including ranking algorithm changes, policy changes, competitor activity, seasonality, and platform availability.

Any ranking claims, screenshots, case studies, or figures shown on the Site describe a specific search term, in a specific market, on a specific date, and are stated as such. They are historical records, not projections, and they are not a representation of what your business will achieve.

4.Dependence on third-party platforms

Our services depend on third-party platforms, including TikTok. Those platforms may change their algorithms, features, terms, policies, pricing, or availability, and may restrict, suspend, or remove accounts or content, at any time and without notice to us or to you. SearchAcre is not responsible for those changes or actions and is not liable for their effect on results.

SearchAcre is an independent company. We are not affiliated with, endorsed by, or sponsored by TikTok, ByteDance Ltd., Google LLC, or Meta Platforms, Inc. All trademarks are the property of their respective owners.

5.Who may use the Site

The Site is intended for businesses. By submitting a form you represent that you are at least 18 years old, that you are authorized to act for the business you name, and that the information you provide is accurate and complete.

You represent that you are authorized to give us the email address and telephone number you submit, and to receive communications at them on behalf of that business.

6.Acceptable use

You agree not to: use the Site for any unlawful purpose; submit false, misleading, or another party's information; attempt to gain unauthorized access to the Site or its systems; scrape, crawl, or harvest content or data except as a search engine indexing publicly available pages; interfere with the operation of the Site; or reproduce, republish, or resell Site content without our written permission.

7.Intellectual property

The Site and its content, including text, layout, graphics, and the SearchAcre name and marks, are owned by SearchAcre or its licensors and are protected by intellectual property law. These Terms grant you no license to them beyond viewing the Site.

Ownership of work produced for a client, including accounts, domains, contact records, and finished deliverables, is governed by that client's Service Agreement and not by these Terms.

8.Messaging terms

These terms apply to the SearchAcre text messaging program.

• Program. SearchAcre sends text messages about your inquiry, your market availability check, scheduling, and work in progress.
• How you opt in. By entering your mobile number and checking the text message consent box on a SearchAcre form, or by texting us first. The box is not checked by default.
• Not a condition. Consent to receive text messages is not a condition of purchase and is not required to receive a market availability check or any other service.
• Frequency. Message frequency varies.
• Cost. Message and data rates may apply. Charges are set by your mobile carrier, not by us.
• Stopping messages. Reply STOP to any message to opt out. You will receive one confirmation and then no further messages.
• Help. Reply HELP for help.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device.
• Your number. Tell us if your mobile number changes or is reassigned, so we do not message someone else.
• Privacy. Mobile opt-in data is handled as described in our Privacy Policy and is not shared with third parties or affiliates for marketing purposes.

9.Third-party links

The Site may link to sites we do not control. We provide those links for convenience and are not responsible for their content, accuracy, or practices.

10.Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SEARCHACRE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEARCHACRE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SEARCHACRE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID SEARCHACRE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, these limits apply to the fullest extent the law allows.

12.Indemnification

You agree to indemnify and hold harmless SearchAcre and its owners, officers, employees, and contractors from any claim, loss, liability, or expense, including reasonable legal fees, arising from your use of the Site, your breach of these Terms, or information you submit that is inaccurate or that you were not authorized to provide.

13.Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction and venue.

14.Changes to these Terms

We may update these Terms. Changes take effect when posted, and the "Last updated" date above will change. Your continued use of the Site after a change means you accept the updated Terms.

15.General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and SearchAcre regarding the Site.

16.Contact
